These Terms of Service ("Terms") govern your use of the LaunchSite OS platform provided by [LaunchSite OS, LLC]. By creating an account or using the platform, you agree to these Terms.
1. The service
LaunchSite OS is software that helps health and wellness coaches manage clients, programming, and communication. It is a tool for practitioners; it is not a medical device and does not provide medical advice.
2. Eligibility and accounts
- You must be at least 18 and able to form a binding contract.
- You are responsible for the accuracy of your account information and for safeguarding your credentials.
- You are responsible for all activity under your account.
3. Coach responsibilities and PHI
- Coaches are responsible for obtaining all necessary client consents and authorizations to collect and process client health information through the platform.
- Where required, a Business Associate Agreement (BAA) between you and [LaunchSite OS, LLC] governs handling of Protected Health Information. Do not upload PHI until a BAA is in place if your use requires one.
- Coaches are solely responsible for the clinical appropriateness of the programs, supplements, and guidance they create for clients.
4. Medical disclaimer
The platform and any AI‑assisted suggestions are informational and do not constitute medical advice, diagnosis, or treatment, and are not a substitute for professional medical judgment. Clients should consult a qualified healthcare provider for medical concerns.
5. Acceptable use
- Do not misuse the platform, attempt to access data you are not authorized to access, or circumvent security or access controls.
- Do not upload unlawful content or use the platform to violate any person's privacy or rights.
- Do not reverse engineer, resell, or scrape the platform except as permitted by law.
6. Fees and subscriptions
Paid plans are billed in advance on a recurring basis as described at checkout. Fees are non‑refundable except as required by law or expressly stated. We may change pricing with prior notice effective on your next billing cycle.
7. Your data and ours
You retain ownership of the content and client data you put into the platform. You grant [LaunchSite OS, LLC] a limited license to host and process it solely to provide the service. We own the platform, software, and brand. Our handling of personal information is described in our Privacy Policy.
8. Service availability
We work to keep the platform reliable but do not guarantee uninterrupted availability. We may modify or discontinue features with reasonable notice.
9. Termination
You may cancel at any time. We may suspend or terminate access for violation of these Terms or to protect the platform or its users. On termination, you may request export of your data within a reasonable period, after which it may be deleted.
10. Disclaimers
The platform is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, [LaunchSite OS, LLC] will not be liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim will not exceed the amounts you paid for the service in the 12 months before the claim.
12. Indemnification
You agree to indemnify and hold [LaunchSite OS, LLC] harmless from claims arising out of your use of the platform, your content, or your violation of these Terms or applicable law, including claims by your clients.
13. Governing law
